I guess it's because us humans have free will, and not all of the choices we make are the ones that will help us out. Some people make 'better' choices than others, and thus positively affect the lives of people around them. Those of us that make more 'bad' decisions may end up negatively affecting the lives of people around us. I guess life is 'unfair' because people are all different and make different choices. If life was 'fair', then everyone would be treated the same, would do the same job, would have the same problems, would have the same relationships, etc etc etc, which kinda seems like a world without free will. And that just sounds boring.

Because fairness is a concept invented by people and like most human related concepts nature doesn't give a damn about it. Also all the things that make people behave unfairly are based on a natural impulse we're hard wired for.
